Negotiation is an exercise in posturing and positioning that often involves a certain level of deception. Although ethics rules generally require a high standard of truthfulness and honesty, the D.C. Rules and the ABA Model Rules permit some deceit in negotiation. In this class, D.C. Bar Ethics Counsel and an experienced business attorney will discuss the ethical line between exaggeration, posturing, or "puffing" and misrepresentation or fraud. This practical course focuses on the ethics issues involved when you are negotiating contracts and handling transactional work for your clients. Find out when you are obligated to disclose information and what ethically risky tactics you should avoid. (A pre-recorded replay of the 9/13/16 class)
